Public Private Partnership

OUR EXPERTISE

At Mahendra & Co., we provide specialized legal services for clients involved in Public-Private Partnerships (PPP), a key mechanism for developing essential infrastructure and services. With extensive experience across a wide range of PPP projects, our team is well-equipped to guide both public and private sector clients through the complexities of structuring, negotiating, and executing these arrangements.

We understand the intricacies of various PPP models and are adept at advising on their application to ensure that our clients’ interests are protected while meeting the legal and financial requirements of the project. Our lawyers have in-depth knowledge of commonly adopted PPP structures, including:

- Build-Operate-Transfer (BOT)
- Build-Own-Operate (BOO)
- Build-Operate-Lease-Transfer (BOLT)
- Design-Build-Operate-Transfer (DBFOT)
- Lease-Develop-Operate (LDO)
- Operate-Maintain-Transfer (OMT)

Our team works closely with clients to ensure that every aspect of the PPP structure — from financing and risk allocation to operational management and legal compliance — is thoroughly addressed. We assist in drafting and negotiating key agreements, including concession agreements, project financing documents, construction contracts, and operation and maintenance agreements.

We also have significant expertise in the application of FIDIC contracts (the International Federation of Consulting Engineers), which are widely recognized as the global standard in construction and infrastructure projects. Our lawyers ensure that FIDIC principles are effectively incorporated into PPP agreements, helping clients navigate the technical and legal challenges involved in major infrastructure projects.

Whether you are a government agency seeking private sector investment or a private entity looking to engage in a public sector project, we offer tailored legal solutions that align with your strategic and operational goals.

Let us guide you through the complexities of Public-Private Partnerships, ensuring successful, sustainable projects. Contact us to discuss how we can support your PPP initiatives.
